The citizen judge is a democratic participation mechanism in the judiciary, aiming to enable ordinary citizens to participate in judicial decision-making and enhance the credibility of the judiciary and the trust of society. Since the implementation of the citizen judge in Taiwan on July 22, 2020, after being passed by the Legislative Yuan, it has been in effect for several years and has undergone various challenges and reforms. The implementation of this system allows citizens to directly participate in judicial trials and have a direct impact on the outcomes of judicial judgments, further enhancing the fairness, diversity, and transparency of the judiciary, as well as increasing societal trust and recognition of the judicial system. Moreover, the citizen judge facilitates the integration of private expertise and social experiences with judges, ensuring the fairness and reasonableness of judgments.
However, the citizen judge also has some shortcomings and limitations. One important issue is the impact and challenges it poses to traditional defense attorneys. Traditional defense attorneys need to provide clear, specific, and easily understandable defense methods to meet the expectations and needs of citizen judge. Additionally, legal aid organizations need to provide sufficient resources and support to ensure that citizen judge can effectively fulfill their responsibilities.
At first,in taiwan,the citizen judge may have been driven by political correctness, overlooking other more important judicial issues. Therefore, it is necessary to further discuss and analyze the citizen judge in order to determine its compatibility with Taiwan's judicial practices and make necessary modifications and adjustments. Particularly in terms of system design, a professional perspective and consideration of Taiwan's unique circumstances are required to ensure the feasibility and effectiveness of the system.
Therefore, this study aims to explore the problems and challenges that the citizen judge may encounter in practice from a policy evaluation perspective. Through in-depth research, the author will identify and address the deficiencies of the citizen judge and provide relevant recommendations to further refine the system.
