近年來醫療院所頻傳醫療暴力事件，病人或病人家屬常因個人情緒或不滿醫療服務等問題，對於醫護人員採取辱罵、恐嚇，強暴、脅迫，甚至肢體傷害等方式而導致醫療業務之執行受到阻礙。此種暴力行為不僅是威脅醫護人員人身安全，亦可能間接癱瘓整個醫療體系，影響全體民眾就醫權利。有鑑於此，衛生福利部及勞動部除了分別在2014年至2016年間制定對應行政措施，立法者亦分別於2014年及2017年對於醫療法第24條及醫療法第106條進行修正，期能有效降低發生醫療暴力之事件。然而依據衛福部醫事司每年統計醫療暴力事件於醫療院所發生之案件，並無降低之趨勢。因此本文將以醫療法第24條及醫療法第106條作為研究基礎，並輔以司法裁判分析，探討修法結果對於降低醫療暴力之發生是否有效果。
本研究觀察醫療暴力在各國盛行率普遍仍高，但仍以言語攻擊及輕傷害現象居多。再者，醫療機構(雇主)及受害者多採息事寧人態度處理，而醫療法第24條、106條修法雖有助於降低醫療暴力的發生，但效果並不顯著。另外，本研究亦發現精神病患因醫療暴力被起訴時，被減刑或免刑之比例並不高。最後，除了建議加重醫療機構之通報責任外，也認為醫療法第24、106條之適用要件除了須妨礙醫療業務之執行外，也應包含「滋擾醫療機構秩序」部分，以有效懲罰醫療暴力的加害者。

In recent years, there have been frequent incidents of medical violence in medical institutions. Patients or their family members often abuse, intimidate, rape, coerce, or even physically harm medical staff due to personal emotions or dissatisfaction with medical services, which hinders the execution of medical services. This kind of violence not only threatens the personal safety of medical staff, but may also indirectly paralyze the entire medical system and affect the right of all people to seek medical treatment. In the light of this situation, apart from the corresponding administrative measures set up by the Ministry of Health and Welfare and the Ministry of Labor from 2014 to 2016, legislators also amended on Article 24 and Article 106 of the Medical Law in 2014 and 2017 respectively so as to reduce incidents of medical violence effectively. However, according to the annual statistics of medical violence incidents in medical institutions by the Department of Medical Affairs of the Ministry of Health and Welfare, there is no obvious downward trend. Therefore, we will analyze actual samples of judicial judgements which are using Article 24 and Article 106 of the Medical Law as the basis to explore whether the results of the amendments of the Medical Law have an effect on reducing the occurrence of medical violence.
This study observes that the prevalence of medical violence is still high in most countries, but verbal attacks and minor injuries are still the majority. Furthermore, medical institutions (employers) and victims often take a calm attitude to deal with the situation. Although the amendments to Articles 24 and 106 of the Medical Law help reduce the occurrence of medical violence, the effect is not significant. In addition, this study also found that when the mentally ill were prosecuted for medical violence, the proportion of sentences commuted or exempted was not high. Finally, we suggest that the liability of notifying authorities about medical violence for medical institutions should be increased. Besides, in order to punish perpetrators of medical violence effectively, the applicable conditions of Articles 24 and 106 of the Medical Law should also include "disturbing the order of medical institutions" aside from "impeding the execution of medical services".
